Claude Pepper (D-Fla) suggested that President Roosevelt clarify the issue with an executive order. Pepper said he thought one rule ought to be made to apply to officers and enlisted men in both the army and navy. adding that as commander in chief the President is the logical person to establish the procedure.

Interpretations Vary The issue arose over varying interpretations by Secretary of War Henry L. Stimson and Secretary of the Navy Frank Knox in response to a query from Sen. Arthur H. Vandenberg (R-Mich) as to whether an officer could accept a nomination for a high public office, could continue in the armed forces during the campaign, and could resign to accept office if elected. Knox replied that the answer to all 1 three questions was yes, but Stimson said merely that no War department regulation would be construed to prevent an army officer from accepting a nomination for the presidency or vice presi- dency.

Official Charged With Hitting Officer Chicago (AP) James W. Smith. 33, of Joliet, president of the C. I. O.

United Steel Workers local 3131, was being held for the grand jury under $500 bond today on a charge of assaulting a federal officer. At a hearing before Edwin K. Walker, United States commissioner. yesterday, George S. Blaydes, a coast guard civilian emplove.

testified Smith has provoked a disturbance at the Central Spare Parts warehouse. Rockdale. and had struck Blaydes. Smith formerly was employed at the warehouse. a department of the navy bureau of yards and docks.

Blavdes related Smith was brought to his office by Joseph Kellv. a warehouse guard who said Smith declined to display his identification badge. "I explained to him that he was required to display his badge at all times in accordance with comnanv Blavdes testified. "He replied that he had shown it to one guard and was tired of showing it. and would show it again when damn good and readv." Blaydes then told Smith he was discharged.
